Kinoko
Terms & Conditions
Last updated: 19 October 2026
1. Who we are
KINOKO is an independent clothing brand inspired by art, nature and a free-spirited way of life. We create streetwear with original illustrations and attention to detail.
The online store is operated by [COMPANY LEGAL NAME], UIC/EIK [COMPANY REGISTRATION NUMBER], registered address: [COMPANY REGISTERED ADDRESS]. [VAT REGISTRATION STATUS AND NUMBER, IF ANY]. Contact: website@kinokoclothing.com, phone: [SUPPORT PHONE]. These Terms apply to consumer orders delivered in Bulgaria and the European Union.
2. Acceptance of these Terms
By browsing the Site, creating a cart or placing an order, you confirm that you have read, understood and accepted these Terms and our Privacy Policy. If you do not agree with them, please do not use the Site or place an order.
We may update these Terms from time to time as described in section 16 below. The version in force at the time you place an order is the one that applies to that order.
3. Products
Kinoko sells hand-drawn streetwear apparel. All products, descriptions, images, sizes and prices are published on the Site and may be changed or withdrawn at any time before an order is placed. We take reasonable care to display colours and details accurately, but slight variations may occur due to screen settings and the handmade nature of our artwork.
Product availability is shown on the Site in real time. An item added to your cart is not reserved until your order is placed; in rare cases an item may sell out before checkout is completed.
4. Prices
All prices on the Site are quoted in Euro (EUR) and include all applicable taxes, including VAT where Kinoko is required to charge it. Delivery costs are shown separately during checkout before you confirm your order and are also summarised in section 7 below.
We reserve the right to correct any pricing error. If an item's correct price is higher than the price stated on the Site at the time of your order, we will contact you before dispatch for instructions or to cancel your order with a full refund.
5. Placing an order
No customer account is required to shop with Kinoko. You choose your items, review your cart, enter your delivery and contact details, choose a delivery and payment method, and confirm your order. Placing an order is an offer to buy; the contract between you and Kinoko is formed when we confirm your order.
Card orders are confirmed once payment has been successfully authorised through our payment provider. Cash-on-delivery orders are confirmed once your order has been accepted and stock allocated. In both cases you receive an order confirmation on the Site and, where email delivery is available, by email.
Please check your delivery details carefully before confirming your order. Kinoko is not responsible for delays or non-delivery caused by incorrect or incomplete address or contact information provided by you.
6. Payment
- Card payment — processed through our payment service provider using a secure, hosted checkout page. Kinoko never sees or stores your full card number; your card details are handled entirely by our PCI-DSS compliant payment provider.
- Cash on delivery (COD) — you pay the courier in cash when your parcel is delivered, for the full order total including delivery.
We accept Mastercard and Visa for card payments. Available payment methods may vary depending on the delivery method you choose and are shown at checkout.
7. Delivery
We deliver in Bulgaria and the European Union with our courier partners Speedy and their delivery network. Available destinations and delivery services are checked during checkout.
Within Bulgaria, delivery to a Speedy office costs €3.00 and delivery to an address costs €5.00. Delivery within Bulgaria is free for merchandise totals of €90.00 or more after discounts.
For other EU countries, the delivery price is calculated automatically by Speedy for the destination, available service and parcel weight. The full delivery price is shown before you confirm and pay for your order. The domestic free-delivery offer does not apply to international shipments.
A tracking link is sent when your order is dispatched. Delivery times depend on the destination and the courier service.
8. Your right to withdraw from the contract (14-day right of return)
You may withdraw from your purchase within 14 calendar days of receiving the goods. Send written notice to website@kinokoclothing.com or use our contact form, including your order number and the items you wish to return. The return procedure is set out in section 9.
9. Returning the goods and getting your refund
Notify us in writing within 14 days of receiving your item. Please return it unused, with all original labels and packaging. You may inspect and try it on as you would in a shop; this does not remove your statutory right to withdraw. You are responsible for any loss in value caused by handling beyond what is necessary to check the item.
After sending your withdrawal notice, return the item within 14 days, at your own expense. Contact us for the return address before sending the parcel.
We refund your payment, including the cost of standard outbound delivery where applicable, within 14 days of your withdrawal notice. We may withhold the refund until we receive the returned goods or evidence that you have sent them back, whichever happens first. Refunds use the original payment method unless otherwise agreed without additional cost.
10. When the right of withdrawal does not apply
In accordance with Article 16 of Directive 2011/83/EU (implemented in Bulgaria by Article 57 of the Consumer Protection Act), the right of withdrawal does not apply to, among others:
- Goods made to your specifications or clearly personalised (for example, a custom print, size or embroidery made specifically for you);
- Sealed goods which are not suitable for return due to health protection or hygiene reasons, if unsealed after delivery (for example, underwear or swimwear, where the hygiene seal has been removed);
- Goods which, after delivery, are, according to their nature, inseparably mixed with other items.
Where none of these exceptions apply, your statutory right of withdrawal under section 8 above is unaffected.
11. Legal guarantee of conformity
Kinoko is liable for any lack of conformity of the goods which exists at the time of delivery and which becomes apparent within two years of that date, in accordance with Directive (EU) 2019/771 and the Bulgarian Consumer Protection Act. This is a statutory guarantee and applies in addition to, and independently of, any right of withdrawal described above.
If your item is faulty or does not match its description, please contact us at website@kinokoclothing.com with your order number, a description of the issue and, where possible, photos. Depending on the situation, you are entitled to have the goods repaired or replaced free of charge, to receive a price reduction, or to terminate the contract and receive a refund, in accordance with the applicable law.
This legal guarantee is separate from, and not limited by, any voluntary commercial warranty we may offer on specific products.
12. Complaints and alternative dispute resolution
If you have a complaint about your order, please contact us first at website@kinokoclothing.com so we can try to resolve it directly. Please note that the European Commission's former Online Dispute Resolution (ODR) platform was permanently discontinued on 20 July 2025 and no longer accepts complaints.
You can find the current list of certified alternative dispute resolution (ADR) bodies for EU consumers at https://consumer-redress.ec.europa.eu/dispute-resolution-bodies. If you are a Bulgarian consumer, you may also refer your complaint to the Commission for Consumer Protection (Комисия за защита на потребителите), 1 Vrabcha Str., Sofia 1000, Bulgaria, phone 0700 111 22, kzp.bg, or, if you reside in another EU Member State, to the equivalent national consumer authority or a conciliation commission for consumer disputes in that country.
Using these bodies is optional and does not affect your right to bring proceedings before a competent court.
13. Intellectual property
All artwork, illustrations, logos, product designs, photography and text on the Site are the intellectual property of Kinoko or its licensors and are protected by copyright and trade mark law. Purchasing a product gives you no rights in the underlying artwork or brand beyond ownership of the physical item.
You may not reproduce, distribute, modify or create derivative works from any content on the Site without our prior written consent.
14. Liability
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot be limited or excluded under applicable law, including your statutory consumer rights described in sections 8 to 11.
Subject to the above, our liability arising out of or in connection with an order is limited to the price paid for the relevant product(s). We are not liable for indirect or consequential losses that were not a foreseeable result of our breach.
15. Force majeure
We are not liable for any delay or failure to perform our obligations under these Terms caused by events beyond our reasonable control, including but not limited to natural disasters, strikes, courier disruption, war or governmental action. If such an event continues for more than 30 days, either party may cancel the affected order and any payments made will be refunded.
16. Personal data
We process your personal data in order to fulfil your order and operate the Site. Full details of what we collect, why, for how long and your rights are set out in our Privacy Policy, which forms part of these Terms.
17. Changes to these Terms
We may update these Terms from time to time, in particular to reflect changes in the law, our services or our business practices. The updated version will be published on this page with a new "last updated" date. Changes do not affect orders placed before the change took effect.
18. Governing law and jurisdiction
These Terms are governed by Bulgarian law. If you are a consumer, this choice of law does not deprive you of the protection afforded by mandatory provisions of the law of the EU country in which you are resident.
Any dispute that cannot be resolved amicably or through the bodies listed in section 12 will be referred to the competent Bulgarian courts, without prejudice to any mandatory right you have to bring proceedings in the courts of your own country of residence.
